Report: Howard Stern Delays SiriusXM Return

Numerous media outlets are circulating a story published in the Daily Mail that Howard Stern did not return to a live broadcast of his SiriusXM program today (9/2) as promised because he is frustrated “over the newimg contract.” Stern’s current five-year deal expires later this fall and speculation earlier this summer that the satcaster and Stern would part ways at the end of his current deal spurred Stern to issue a statement on his show (during summer re-runs) that he’d be back on September 2 to dispel the rumors. There are reports that Stern is dealing with his 98-year-old mother’s failing health and that is weighing on him. The story indicates Stern sent an email to his employees to explain the situation, but sources supplied no details about that email. The New York Post story says Stern’s listenership has gone from “20 million at its height to 125,000 daily listeners now.” However, SiriusXM doesn’t publish its listener data and no sources are provided for those figures. When the Library Talks Back

imgImagine SiriusXM acquires the complete Howard Stern archive – every show, interview, and on-air moment. Months later, it debuts “Howard Stern: The AI Sessions,” a series of new segments created with artificial intelligence trained on that archive. The programming is labeled AI-generated, yet the voice, timing, and style sound like Stern himself.

Owning the recordings might suggest the right to create new works from them. In reality, the answer is more complicated – and the music industry offers a useful comparison.

Music Industry Precedent

Sony, Universal, and others have spent hundreds of millions buying music catalogs from artists such as Bob DylanBruce SpringsteenPaul Simon, and Queen. These deals often include both composition rights and master recordings, giving the buyer broad control over licensing and derivative works.

In music, the song and the recording are the assets. In talk content, the defining element is the host’s persona – voice, cadence, and delivery – which changes the legal analysis when creating new material.

Copyright and Persona Rights

Buying a talk archive usually transfers copyright in the recordings and any scripts. That permits rebroadcast, excerpts, and repackaging of original programs.

It does not automatically transfer the host’s right of publicity – control over commercial use of their name, likeness, and in many states, their distinctive voice. In Midler v. Ford Motor Co. (1988), the court ruled that imitating Bette Midler’s voice in a commercial without consent was an unauthorized use of her identity.

This means a company can own the shows without having the right to make new performances in the host’s voice unless the contract clearly grants that right.

The AI Factor

AI technology can replicate a host’s voice, tone, and style with high accuracy, producing entirely new programming.

Outside broadcasting, a recent AI-generated George Carlin special – written by humans but performed by a voice model trained on decades of his work – sparked debate about rights and legacy.

In talk radio, similar AI use could create “new” episodes featuring well-known hosts. Even with clear labeling, right-of-publicity claims may arise if the host or their estate never authorized it. Disclaimers may address consumer confusion but do not remove identity-rights issues.

Why It Matters

This applies to more than national figures. Any broadcaster or podcaster with a substantial archive could face it. Selling or licensing a library could give the buyer the tools to replicate your voice without your participation.

For buyers, the ability to produce new content from archived material has commercial appeal. But without the right to use the host’s voice for new works, it carries significant legal and reputational risk.

Contracts Decide

The key is in the contract:

— Did the talent assign rights to their name, likeness, and voice for future works?
— Is use limited to original recordings or extended to derivative works?
— Does it address future technologies, including AI?

Older agreements often omit these points, leaving courts to decide. Future contracts will likely address AI directly.

Takeaways

For talent: Know what you are transferring. Copyright ownership does not necessarily include your future voice.

For buyers: Owning an archive does not automatically give you the right to create AI-generated new material in the original host’s voice.

For everyone: As AI advances, control over archives will depend on the contracts that govern them.

Report: Current Contract with SiriusXM is Stern’s Last

SABO SEZ: The Myth About Wall Street

By Walter Sabo
CEO, Sabo Media Action Partners
A.K.A. Walter M Sterling
Daily host, WPHT Philadelphia
Weekly host, Talk Media Network

imWall Street investors do not put up money for traditional radio and television stations.

That myth has been a burden within our culture for about 10 years and it just is not true. From a 1980s fast-buck perspective, traditional media does not offer the no-effort returns it once did. But major investors continue to seek opportunities from radio and TV acquisitions. Notably, today the money is much “smarter” than that found in the 1980s.

(Side note, the 1980s rush to radio put the business in the hellish financing we live with today. The new money won’t do that.)

Marc Rowan is the CEO of Apollo Advisors which bought Cox TV and radio. Apollo was first money in Sirius radio. Their escrow check closed the deal for Howard Stern and changed the radio industry. Marc explained to me that Apollo is not an investor, they are “owners.” Apollo has a long game plan as savvy operators with decent, moral standards. Marc actually likes, consumes and celebrates media. Apollo is not a chop shop. They build businesses.

George Soros is about to close on Audacy. Mr. Soros is a brilliant business builder. Like Apollo, he is an owner/operator. Soros represents smart money going into the proven medium of radio.

John Malone, builder of the cable industry, saved Sirius within days of bankruptcy. The company was about to miss payroll, Malone pulled it out the fire and through Liberty holdings he continues to control 83% of SiriusXM. Over the years he has grown, not diminished Liberty’s stake in the satellite company.

Rowan, Soros, and Malone have one thing in common: They are not jokers. They each have robust histories of sober, sane investments which has made them billionaires. While you and I shop the price of milk, the new owners of proven media are model guides for future Wall Streeters.

Walter Sabo has been a C Suite action partner for companies such as SiriusXM, Hearst, Press Broadcasting, Gannett, RKO General and many other leading media outlets. Talent Agent Don Buchwald Dies at 88

DonBuchwaldAs originally reported by TMZ, well-known talent agent Don Buchwald died this past Monday (7/22) of natural causes at his Massachusetts home, where he was “surrounded by loved ones.” Buchwald formed his bi-coastal agency Don Buchwald & Associates in 1977 with five associates. The firm employs 130 employees who work across many platforms of entertainment and media. His most notable client, of course, was/is Howard Stern, as well as Stern’s longtime co-host, Robin Quivers. According to TMZ – Buchwald represented Stern personally, “while also acting as his manager and publicist. Stern was Don’s single personally-handled client and Howard referred to ‘super-agent Don Buchwald’ over the years on the radio. Buchwald was instrumental in helping Stern land a megadeal at SiriusXM worth an estimated $90 million a year.” Creator of SiriusXM’s Howard Stern Channels, Sabean Media president Tim Sabean posted on X, “I lost my closest pal today. You left an iconic legacy. I miss you with all my heart and soul. RIP my dear friend.” In a similar post, former SiriusXM SVP of sports programming Steve Cohen notes, “RIP my dear Don from Bensonhurst. An incredible friend, mentor and philanthropist. When I was down, you lifted me up. You made me smarter, wiser and taught me to be a deep thinker. Deepest condolences to the Buchwald family.” When Buchwald and Stern first met, they sat down in Buchwald’s office and talked for an hour. In a 2018 interview, Stern told The New York Times, “He turned to me and said, ‘You know, your career could be as big as Johnny Carson’s.’ I thought this guy might be a little bit nuts. But he believed in me from the very beginning, more than I believed in myself.” Having had no interest in being in the spotlight, Buchwald was quoted in that aforementioned article, “I’m not a particularly boastful person.” Don Buchwald was 88 years old.
